Cheb Mami receives five years in forced-abortion case

Four years of legal manoeuvring on two continents ended Thursday for Cheb Mami. Fans now wonder whether the rai legend's career will survive five years in a French prison.

Rai music superstar Cheb Mami was sentenced to five years in prison on Thursday (July 2nd) by a French court, bringing an end to a long legal battle over a 2005 forced-abortion attempt on his ex-girlfriend.

Fans of the French-Algerian singer fear the ruling will also spell an end to his career in music.

The Bobigny court found Cheb Mami – whose real name is Mohamed Khelifati – guilty on a variety of charges, including accessory to abduction, false imprisonment, violence, administration of harmful substances, threats, and intimidation directed at his former lover, magazine photographer Isabelle Simon.

Also sentenced in connection with the crime were manager Michel Levy (four years), Kader Lallali (six years) and Hicham Lazhar (three years). Lallali and Lazhar were sentenced in absentia. Isabelle Simon was awarded 95,000 euros in damages.

Observers familiar with the history of the case were surprised to hear Mami's answers to the president of the court, which suggested he was present during the abortion attempt at his villa in El Biar, Algiers. He maintained for four years that he was away in Oran at the time of the crimes.

"I saw the foetus… I don't know, I don't know… I made a mistake," he said. "It's against my principles, my religion. I can't explain it. I made a mistake, a serious one, it's a nightmare. I wasn't at the villa, but I knew what was happening".

He said the abortion was suggested by ex-manager Michel Levy.

"It was Michel's idea," he told the Bobigny court. "I agreed to it in my panic. If he hadn't raised the possibility, I would never have thought of it. But I didn't do anything to stop him," he concluded.

It also emerged during the trial that Mami offered- through Michel Levy - to pay Isabelle Simon to dissuade her from filing a complaint. The singer then suggested she have an abortion in the United Kingdom – for which he was prepared to spend 100,000 euros – in order to avoid becoming the father of "an illegitimate child".

Levy denied any involvement in the affair.

Kader Lallali, a confidant of Mami, and Hicham Lazhar, a colleague of Levy – were not present for the trial. Lallali fled to Algeria and Lazhar failed to appear in court.

Reactions to the events vary.

Algerian daily Quotidien d’Oran predicted that the singer would only serve part of his time in prison. "If his sentence is remitted, Cheb Mami could be free in just over two years' time. He broke down when admitting his 'serious mistake' but claimed to have been 'trapped' – because he did not want the child that his partner was carrying," the newspaper wrote.

El Watan was more critical: "What future awaits the rai star who has sold some 20 million records worldwide? One thing is for certain: his career as a musician has gone up in smoke. In Algeria his image as a kind man and the prince of rai is somewhat tarnished to say the least."

Mami's life, the paper claims, has undergone a "spectacular turnaround".

"It was in Bobigny, in Seine-Saint-Denis, that the boy from Saida embarked on his international career in 1986. Twenty-three years on, it was at a court in Bobigny, just a stone's throw from the hall where he used to sing, that he was put on trial and sentenced," the article concludes.

Mami will not lodge an appeal, according to his lawyer, Claire Doubliez, who said that he was "relieved" at the conviction "because it's all over, but is also frightened by the thought of having to spend five years in jail".

Small mistakes always drive its perpetrators to difficult and unexpected results which can be seen easy in their eyes. However, for others this result makes him lose the trust of people around him and uncover the ugly face. God says if you do a good act you will reap a good result and if you do an evil act you will reap an evil act. These are the results of adultery acts with infidels. You assume full responsibility. God endowed you with a mind but you used it in negative acts which stir the anger of God the Almighty. I hope I wasn't long. Sincerely yours.

There was no abortion. The mother is doing well. The little girl is now three years old and behaves like an angel. So, there was no "crime", simple an attempt at one that completely failed. And, he gets five years in prison for it!? If the forced operation had succeeded, would the guilty party be sentenced to 500 years in prison??? What if this attempt had taken place in a country of the Maghreb??? Do you think that the charges would not have been seen through to the end? Yes, the woman would be defended, but, abusing one person in order to make an example for others is likewise unjust.

These are lies about the singer. He was not in France in 1986; he did his compulsory military service in 1987.

He needs help. I think that he does not deserve his fate. It was a mistake, and he did not deny it. Everyone makes mistakes, even more serious ones, so relax.

What is with these sexist and lax comments!? He did not snort a white line or run a red light!!! He drugged, kidnapped and tried to force an abortion on a woman!!! "Hey now! Oh, those boys."!?! Open your eyes! Moreover, laying the blame on others is easy. I do not this that some other person could have forced such an idea on him. Just for your knowledge, I am convinced that the idea came from the twisted mind of this "gentlemen", not the "others" he speaks of!!! Whatever the case may be, he did not get everything he deserved!!! To this regard, reread the Qur'an and re-learn the respect for human beings and for women! You comments are shameful!!!

Prison for men. Mami, may God release you in good condition.

Oh Lord release him and grant him patience, amen. He won't do it again.

I am equaly surprised and disgusted, mami is, was one of my favourite rai musicians, I loved his music, and I thought he was a nice man. but?...... he can not blame anybody but himself. he is a grown man, and he knew exactly what was going on is wrong. and that is why, I guess he tried to force the abortion on his girlfrend in Algeria. because he wouldn't find anybody crazy enough to do it in france or they would face the same faith he is facing today. He should've known very well that the french would make an exemple of anyone doing what he did to one of their own. he might survive this in north Africa and remains to be popular there, but I doubt it if anyone in Europe would ever want to work with him again.

Salam alikum. A news with a moral. My brothers, firstly God the Almighty says in His sacred Book “O men! eat the lawful and good things out of what is in the earth, and do not follow the footsteps of the Shaitan; surely he is your open enemy. He only enjoins you evil and indecency, and that you may speak against Allah what you do not know” (Al Bakara: 168-169). This human Cheb Mami threw himself in this plight. He was aware of this but the evil soul. We shouldn't forget that what happened to the brother Mami could bear his good as it may be that you dislike a thing while it is good for you, and it may be that you love a thing while it is evil for you. This is something nice as the brother might return to the right path and repent sincerely to God. This is the will of God the Almighty. We should all pray God for him to forgive him and make him one of those who remember God much. I thank Magharebia site for the news.

If anyone commits a mistake he deserves punishment. Law is above all. His songs and fame won't help him in prison.

Anonymous Posted 2009-07-21

By God someone who does such an act deserves more than this. May God guide us, that's all.

hamza khan Posted 2009-07-22

mami i will pray for you

KHAN Posted 2009-07-22

i will pray for you mami u will came out soon out of jail

valeoni Posted 2009-08-04

Where there's smoke, there's fire. Surely, Mami is guilty in one way or another. Go on, forget about it; it is just music. What else does he do with his life? What, is he a rocket scientist?

حسام دبي Posted 2009-08-12

Acknowledging mistakes is a virtue. His career has begun now in prison, no worries about him. He will certainly learn from the past. We ask God to forgive his sins. May God assist...

Azouz Posted 2009-08-23

He is just a human like you and me, nothing else brothers and sisters, we all make mistakes, we all fall , regardless of your fame, Class, religion or any of your qualities or character. Even Allah blamed Sayidouna Mohamed(S.A.A.wa salam) for making a mistake with a Blind-man, and that's in the Quran. The best of us are those who learn from their mistakes.
